Labor And Workforce Development Grants Permanent Variance To Channel Construction Inc.

Jul. 15, 2002
No. 02-38

In accordance with AS 18.60.077, the Department of Labor and Workforce Development has granted a permanent variance from safety and health standards prescribed in 29 CFR 1926.905(h) to Channel Construction, Inc.

Channel Construction Inc. requested a permanent variance to allow them to perform drilling activity no closer than 25 feet to loading operations at the Scow Bay Water and Sewer Project (Ph 4) in Petersburg, Alaska adjacent to Mitkof Highway. This activity will be allowed when bore holes fall under severe ground conditions including a high water table, trenching requirements for type c soil and the need for trench boxes.

The department granted the permanent variance because it is satisfied that Channel Construction Inc.'s proposed alternatives and the specific conditions set out in the variance will ensure worker protection that is at least as safe and healthful as that required by the standard.

A copy of the Grant of Permanent Variance is available upon request from the Division of Labor Standards and Safety, Department of Labor and Workforce Development, P. O. Box 111149, Juneau, AK 99811-1149, or by calling Lillian Prevette in Juneau at (907) 465-6005.
