Labor And Workforce Development Grants Interim Order Ex Parte To Energy Recovery Services, Inc.

The Department of Labor and Workforce Development has granted an interim order ex parte from safety and health standards prescribed in 29 CFR 1910.106 (b)(4)(iv)(g) to Energy Recovery Services, Inc. pending a decision on the company's application for a permanent variance.

Energy Recovery Services requested a permanent variance that would allow them to retain the inlet fill pipe located inside their building at 2020 Viking Drive, Anchorage, Alaska, rather than relocate the inlet fill pipe outside the building. This building was specifically designed for oil recovery, with provision for potential spill containment, a vapor exhaust system, and liquid and weather protection. The applicant has stated that in accordance with recommendations, the flashpoint of the oil being transferred will be tested.

The department granted the interim order ex parte because it is satisfied that Energy Recovery Services' proposed alternative will ensure worker protection that is at least as safe and healthful as that required by the standard.
